Section 9(1) — Marks Without Distinctive Character
Marks that are: (a) devoid of distinctive character, (b) descriptive of goods/services, (c) customary in trade, or (d) likely to deceive or cause confusion — shall NOT be registered.

📋 Section 11 — Relative Grounds (Conflict)
Section 11(1) — Identical/Similar Marks
A mark shall NOT be registered if it is identical/similar to an earlier mark, and goods/services are identical/similar, creating likelihood of confusion.
Overcoming Section 11 Objections
- Show Dissimilarity: Visual, phonetic, conceptual differences
- Different Classes: No overlap in goods/services
- Coexistence Letter: NOC from cited mark owner
- Prior User: Prove you used mark before cited mark
