4. Patent Filing Process

Startup Recognition
Startups recognized by DPIIT are eligible for 80% fee reduction in patent filing. Form 28 (Declaration of Startup) must be filed along with certificate of recognition.
6. Examination and Prosecution
First Examination Report (FER)
The FER may contain objections related to:
- Formal Objections: Issues with forms, documents, or procedural requirements
- Section 3 Objections: Subject matter not patentable (e.g., Section 3(k) for software)
- Novelty Objections: Prior art citations showing lack of novelty
- Inventive Step: Obvious over cited prior art
